Terms of Service for DEUX

DRAFT, NOT YET PUBLISHABLE. Generated 2026-10-09 from the legal skill's template and adapted to DEUX. Not legal advice; have a lawyer read it (see docs/legal/README.md). Apple's standard EULA applies to the license of the app itself unless you upload your own; these terms cover the service, accounts, subscriptions and conduct.

Effective date: [EFFECTIVE_DATE]

These terms are between you and Elena Rudinski ("we", "us") for the DEUX app and service. By creating an account or using DEUX you agree to them and to our Privacy Policy. If you do not agree, do not use DEUX.

1. Who may use DEUX

You must be 18 or older and legally able to enter this agreement. DEUX is intended for consenting adult couples. You confirm your age when you sign up. We may suspend accounts we believe belong to minors.

2. Your account

Keep your password private; you are responsible for activity on your account. Give accurate information. Tell us at support@letsdeux.com if you think someone else has accessed your account. One person, one account.

3. Linking with a partner

You choose whether to link with a partner. Only link with someone you know and who has agreed to it; the person who generates the pairing code must approve the request. Linking lets each of you see the other's sessions, ratings, settings and notes, as described in the Privacy Policy. You can unlink at any time. Do not share your pairing code with strangers, and do not use DEUX to monitor, track, pressure or control another person.

4. How you may use DEUX

You agree not to: use DEUX for anything unlawful; use it with or about anyone who has not consented; harass, threaten or abuse anyone through the app; try to access other people's accounts or data; probe, scan or attack the service; copy, reverse-engineer or resell the app or its content, except as the law allows; or upload anything that is not yours to share.

4a. Third-party apps and devices

5. Health and safety

DEUX suggests positions and activities. It is not medical or professional advice, and it is not a medical device. It is for personal enjoyment and general wellbeing, not for diagnosing, treating or preventing any condition. Activities can strain or injure you. Know your own limits, stop if something hurts, communicate with your partner, and talk to a doctor if you have health concerns, injuries or pregnancy. You take part at your own risk. DEUX does not replace consent: consent must be given freely and can be withdrawn at any time.

6. Your content

You own the notes, lists and other content you create. You give us a limited license to store and process it only to run DEUX for you and your linked partner. We do not use it for advertising or sell it.

7. Our content

The app, its poses, illustrations, text and design belong to Elena Rudinski or its licensors and are protected by law. You may use them for your own personal, non-commercial use inside DEUX.

8. Subscriptions and purchases

Some features need a paid subscription ("Premium"). Prices and periods are shown before you buy. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel in your Apple ID account settings. Any free trial ends when you buy, unless you cancel first. Refunds are handled by Apple under its policies, not by us. If you are linked to a partner who has Premium, you may share access while you are linked; it ends when you unlink or their subscription ends. [GATE: the paywall wording must say the same; it now carries these disclosures.]

Apple. These terms are between you and us, not Apple. Apple's standard End-User License Agreement applies to your licence to use the app; Apple has no obligation to provide support for it, and Apple is a third-party beneficiary of that licence.

9. Ending your account

You can delete your account in Settings at any time; this deletes your data as described in the Privacy Policy. We may suspend or end accounts that break these terms or put others at risk. Sections that by their nature should survive (disclaimers, liability, governing law) do.

10. Disclaimers

DEUX is provided "as is" and "as available". We do not promise it will be uninterrupted, error-free or fit for any particular purpose, or that any session will suit you. Some places do not allow certain disclaimers, so some of this may not apply to you.

11. Limit of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, and our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim and US$50. Nothing here limits liability that cannot be limited by law. [LAWYER: review for the states you launch in.]

12. Changes

We may update these terms. If a change matters we will tell you in the app before it takes effect; continuing to use DEUX after that means you accept it.

13. Governing law

These terms are governed by the laws of Florida, USA, and disputes go to the courts there. If you are a consumer outside the United States, nothing in these terms takes away the mandatory consumer-protection rights of the country where you live, including your right to bring a claim in its courts. [LAWYER: add an arbitration / class-waiver clause only if you want one.]
